Terms and Conditions of Sale
1. Prices, Taxes and Payment Phosphorex, LLC reserves the right to change the prices and specifications of its products at any time without notice, unless otherwise explicitly specified in a written customer product quote. Any tax, duty, custom or other cost of any nature shall be paid by Buyer in addition to the price quoted or invoiced. Payment is expected 30 days after the invoice date. Phosphorex reserves the right to charge a late fee to invoices outstanding beyond 30 days after the invoice date. Phosphorex may refuse to sell to any Buyer whose account is overdue for a period of more than 60 days or who has an unsatisfactory credit or payment history. Buyer is responsible for all collection costs on past due accounts. Payment must be made in U.S. dollars, with checks being drawn on a U.S. Bank. International money orders, VISA, MasterCard, and American Express are also accepted. If payment is made by one of these credit cards, a card number, expiration date, and name as printed on the card must be included. 2. Shipping Phosphorex will make every effort to ship the products in accordance with the requested delivery date, provided that Phosphorex accepts no liability for any losses or for damages arising out of delays in delivery. Shipments will be made F.O.B. point of distribution by Phosphorex. Products shipped with dry ice are subject to a handling charge. Freight, insurance and any handling charges will be prepaid by Phosphorex and added to the invoice amount. Phosphorex may use UPS, FedEx, DHL and other carrier services. Outside the U.S., Phosphorex ships via Federal Express International. 3. Use All products are intended for research use only and are not to be used in humans or for any diagnostic and/or therapeutic purposes. The information on this website is believed to be accurate, but all recommendations are made without warrant. Phosphorex, LLC disclaims any liability in connection with the use of the information, and does not warrant against infringement by reason of use of its products in combination with other materials or in any process. 4. Warranty Phosphorex warrants that its products will reasonably conform to the product description that accompanies each product, for a period of thirty (30) days from the shipment date of the product (the “Warranty Period”). If a product has a defect in materials and workmanship during the Warranty Period, Phosphorex will either refund to Buyer the purchase price of the product or replace such product, minus a restocking fee of 20% of the product value. To properly make a warranty claim, Buyer must call Phosphorex Customer Service at (877) 288-8010 prior to the expiration of the Warranty Period. PHOSPHOREX SHALL NOT BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL OR ANY OTHER DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PROPERTY DAMAGE, DAMAGE TO OR LOSS OF EQUIPMENT, LOST EXPENSES, PROFITS OR REVENUE, COSTS OF RENTING REPLACEMENTS, AND OTHER ADDITIONAL EXPENSES. 5. Governing Law The validity of these Terms and Conditions of Sale as well as their interpretation and construction shall be governed by the laws of the Commonwealth of Massachusetts. |
